JumaLink Terms of Service

Welcome to JumaLink. These Terms of Service (the "Terms") are an agreement between you and JumaLink, and they govern your access to and use of the JumaLink mobile application, website, and marketplace services.

By creating an account and accepting this version, you agree to these Terms and to the JumaLink Privacy Notice, which is incorporated into them by reference. If you do not agree, do not use the Platform.

1. Definitions

  • "Platform" means the JumaLink mobile application, website, management tools, and marketplace services, together with any feature we make available through them.
  • "Artisan" means an independent tradesperson who offers services through the Platform.
  • "Client" means a person who uses the Platform to find and request services. The app refers to a Client account as a customer account.
  • "Job" means a service a Client requests from an Artisan through the Platform.
  • "Content" means text, images, video, reviews, messages, and other material you submit to the Platform.
  • "we", "us", and "our" mean JumaLink. "you" means the person agreeing to these Terms.

2. Our role in the marketplace

JumaLink helps Clients discover and communicate with independent Artisans. We operate the marketplace; we do not perform the advertised trade services.

Artisans are independent service providers. They are not employees, agents, partners, or joint venturers of JumaLink, and no Artisan may hold themselves out as any of those. A Job is an agreement between the Client and the Artisan. JumaLink is not a party to it.

We do not guarantee that an Artisan is suitable for a particular Job. A "verified" badge means only that we completed the checks the badge represents at the time it was granted. It is not a warranty of workmanship, licensing, insurance, or future conduct, and you remain responsible for satisfying yourself that an Artisan is right for your Job.

3. Eligibility and your account

You must be at least 18 years old and legally able to enter into a contract. The Platform is not directed to children, and we do not knowingly allow anyone under 18 to create an account.

You agree to provide accurate registration information, keep it current, protect your credentials, and tell us promptly if you suspect your account has been misused. You are responsible for activity that takes place under your account.

Client registration is available in the mobile app. A Client may apply to become an Artisan, and we may also invite an Artisan directly. Applying or receiving an invitation does not by itself grant marketplace authority: an Artisan profile remains non-public until onboarding is complete, the Artisan has personally accepted the current Terms and Privacy Notice, and JumaLink has approved and verified the profile.

4. Acceptable use

When you use the Platform, you agree not to:

  • impersonate another person or misrepresent your identity, qualifications, licences, or affiliation;
  • evade a suspension, restriction, or removal;
  • scrape, crawl, or harvest data from the Platform, or probe, scan, or test the security of the Platform or its infrastructure;
  • interfere with the operation of the Platform or the experience of other users; or
  • use the Platform for unlawful, fraudulent, harassing, discriminatory, or unsafe purposes.

5. Requesting and completing Jobs

A Client may request a Job from an Artisan, describing the work, the selected service, and any agreed price. The Artisan must accept the request before work begins. The Platform records the progress of each Job and keeps a history of the changes made to it, which we and the parties can refer to in a dispute.

When an Artisan marks work complete, the Client can confirm completion, dispute it with a reason, or take no action. If the Client takes no action before the confirmation deadline shown on the Job, the Job completes automatically. The current default deadline is seven days after the Artisan's completion notice. We may change that default for future completion notices, but a Job keeps the deadline that applied when it was marked complete.

When an Artisan marks work complete, we may use location data to help verify that the work was carried out, and may take what that indicates into account when settling a report or dispute.

Such a check is an indicator only. It does not decide whether a Job is complete, override a Client's confirmation or dispute, or establish that either party is at fault, and a check that reaches no conclusion is not evidence against anyone. It is a record we hold to help resolve a dispute; it is not shown to the Client as a verdict on the Artisan's work.

An automatic completion is recorded distinctly from a Client's confirmation. It is an administrative status only, and it does not prevent you from reporting fraud, a safety incident, or any other problem to our support team.

6. Reviews

A review may be submitted only for a completed Job, only by a party eligible to review it, and only once for that Job and recipient. Reviews must reflect a genuine experience. We may moderate or remove a review that is abusive, unlawful, or otherwise in breach of these Terms.

7. Fees and commission

JumaLink does not currently collect or hold payment for Jobs. Clients and Artisans arrange payment directly, for example by cash or mobile money, and are responsible for confirming the recipient and keeping their own receipts.

The Job record stores a 5% Artisan commission rate for Jobs obtained through JumaLink. The Platform does not currently issue an invoice for that commission, collect it, penalise non-payment, or represent it as paid. A stored rate is not evidence that JumaLink has received money. We will give Artisans notice, and obtain any acceptance the law requires, before enabling a collection or enforcement process.

Because JumaLink is not the payment processor, refunds for Artisan services are normally arranged between the Client and the Artisan. Our support team may help investigate or mediate, but we do not promise compensation or any particular outcome.

8. Safety, reports, and disputes

You are responsible for evaluating a Job, communicating its scope and safety requirements, and complying with applicable licensing and workplace rules.

Please use the report and block features for spam, harassment, fraud, unsafe behaviour, or inappropriate content. In an emergency, contact your local emergency services. The Platform is not an emergency-response service.

To moderate the Platform or assist with a dispute, we may review Job history, location recorded for the Job, relevant messages, reports, and account records. Our moderation decisions govern access to JumaLink only. They do not replace, limit, or determine any right or remedy available to you under Ghanaian law.

9. Your Content

You keep ownership of the Content you submit. You grant JumaLink a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, resize, convert, transcode, display, and transmit that Content only as needed to operate, secure, support, and promote the Platform.

You confirm that you hold the rights necessary to grant that licence, and that your Content is lawful and does not disclose another person's private information. The licence ends when the Content is deleted, except for the limited retained and backup copies described in the Privacy Notice, and for Content already lawfully used in materials that cannot reasonably be recalled.

We may remove Content that breaches these Terms or the law.

10. Our intellectual property

The Platform, including its software, design, text, graphics, and the JumaLink name and logo, belongs to JumaLink or its licensors and is protected by intellectual property law. These Terms grant you a limited, personal, non-transferable, revocable licence to use the Platform for its intended purpose. They do not transfer any ownership to you, and you may not copy, modify, distribute, or create derivative works from the Platform except as the law permits.

11. Suspension and termination

You may stop using the Platform at any time, and you may delete your account in the app. Deletion is handled as described in the Privacy Notice.

We may suspend, restrict, or terminate an account for a material breach of these Terms, fraud, harassment, a risk to the safety of users, or where the law requires it. Where it is reasonable and lawful to do so, we will tell you why.

Sections that by their nature should survive termination will do so, including sections 9 to 14 and section 17.

12. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the extent permitted by law, we disclaim implied warranties that cannot reasonably apply to an intermediary marketplace, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or secure against every threat, or that any Artisan or Client will perform as agreed.

13. Limitation of liability

To the extent permitted by law, JumaLink is not liable for the independent acts or omissions of an Artisan or a Client, for indirect, incidental, special, or consequential loss, for loss of profit, goodwill, or data, or for loss caused by information that a user supplied incorrectly.

Nothing in these Terms excludes or limits liability that Ghanaian law does not permit us to exclude or limit, including liability for death or personal injury caused by negligence, or for fraud. Any limitation applies only to the extent that it is lawful and proportionate to the claim concerned.

14. Indemnity

To the extent permitted by law, you agree to indemnify JumaLink against claims, losses, and reasonable costs arising from your breach of these Terms, your misuse of the Platform, your Content, or your performance of, or failure to perform, a Job. We will notify you of any claim we ask you to cover and will not settle it without your consent, which you may not unreasonably withhold.

15. Privacy

The JumaLink Privacy Notice explains what personal data we process, why, how long we keep it, and how you can access, export, correct, or delete it. Please read it alongside these Terms.

16. Changes to these Terms

We may update these Terms for legal, safety, or product reasons. For a material update we will publish a new version and require your acceptance before you continue to participate in the marketplace. A change does not retroactively alter a Job that has already been agreed, unless both parties consent.

17. Governing law and complaints

These Terms are governed by the laws of the Republic of Ghana, and the courts of Ghana have jurisdiction over any dispute arising out of them.

Before starting formal proceedings, please contact us so that we can try to resolve the matter with you. This does not limit your right to approach a competent court or regulator at any time.

18. General

These Terms, together with the Privacy Notice and any additional terms we present for a specific feature, are the entire agreement between you and JumaLink about the Platform, and they replace any earlier understanding on the same subject.

If a provision of these Terms is held to be invalid or unenforceable, the rest remains in force and the provision concerned applies to the fullest extent the law allows.

If we do not enforce a provision straight away, that is not a waiver of our right to enforce it later.

You may not assign or transfer these Terms without our written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets, provided your rights under them are not reduced.

We may give you notice through the app, by email to the address on your account, or by posting to the Platform.
